Employment Law Reforms Announced to Shake Up the Work Place and Encourage Businesses to Hire Again, reports Thomas Mansfield

Business Secretary Vince Cable has announced reforms to the UK’s employment laws that make it easier for employers to dismiss under-performing employees. The amended laws include settlement agreements which will give employers the opportunity to pay-off under-performing staff to prevent future claims of unfair dismissal. Although workers are not obliged to accept a pay-off, if they do so it will be legally protected and as such cannot be brought up as evidence in a future court case or tribunal.

At the same time, the maximum limit for a pay out for unfair dismissal is being reduced. It currently stands at £72,300, but MPs want this reduced to a maximum of 12 months’ salary. The aim is to encourage employers, particularly small and medium sized firms, to employ more people.

Critics say the proposals only benefit employers and remove rights from workers, but many employers, particularly smaller firms, should find some benefits, including savings of time and resources, and greater security.

Thomas Mansfield, employment solicitors London based, points out these new settlement agreements are pretty much the same as the existing compromise agreement system. Currently employees and employers can come to a specific agreement over a financial pay out from the employer in return for the employee bringing no claims against the employer in the future. Free legal representation is offered as part of this package, and Thomas Mansfield predicts it will be included in the new settlement agreements too.

The UK’s legal system is a confusing one and often beyond the reach of the ordinary worker. Thomas Mansfield is well placed to provide advice, support and representation on matters relating to employment law, including unfair dismissal and employment tribunals. It predicts the new rules are bound to cause further confusion among both employers and employees and advises anyone confused by the new laws to seek out legal advice when necessary.

National Disability Employment Awareness Month: Workers Enjoy Second Chance

The economic downturn continues to hurt nonprofit organizations that are assisting disadvantaged individuals. An automotive supervisor led a crusade to assist disabled workers during National Disability Employment Awareness Month and shares her book proceeds with a nonprofit organization.

With millions of individuals out of worker, many people forget that disabled individuals are dealing with higher unemployment rates. October marks National Disability Employment Awareness Month (NDEAM), which is a national campaign to raise awareness about disability employment issues. In most circles, the plight of this group is forgotten.

Noriko Iwanaga Chapman, who is a production control supervisor for DENSO Manufacturing (TN), helped to restore $75K of government funding to the Tennessee Vocational Rehabilitation Center (TRC’s), located in Maryville. In 2009, the Maryville TRC was ranked at eighth in contract sales in Tennessee. Its mission is to provide services that help lead individuals who have a physical and/or mental disability to employment and are designed to meet individual needs.

As a result of a college project, Chapman became connected to this organization. She observed, “I was inspired by the staff and by individuals with disabilities who were trying very hard to learn work skills and seek permanent employment.” DENSO Corporation, headquartered in Kariya, Aichi prefecture, Japan, is a leading global automotive supplier with customers that include all the world’s major carmakers. With more than 200 subsidiaries and affiliates in 35 countries and regions (including Japan), DENSO had worked to assist the nonprofit organization with a contract that allowed disabled workers to earn income. In reality, DENSO was offering these workers a second chance.

Chapman was sympathetic about second chance opportunities anyway. Chapman, a mother of two, with over 16 years’ experience in the automobile industry, and is also a cancer survivor. Chapman notes, “In 2009, when I was diagnosed with cancer, it was devastating to think about the disease and an unknown future. A year later, I survived and gained my health back and was given a second chance to live.” She regained her strength and managed to attend Lincoln Memorial University (LMU) and enrolled in its MBA Program. It was the start of her quest to help nonprofit organizations.

Her research was the main inspiration for her new book, Second Chance: An In-depth Case Study on Nonprofit Organization’s Resource Allocation and Operational Maximization. It is co-authored by her LMU professor Dr. Daryl D. Green. The authors pledged 30 percent of the proceeds to a local nonprofit, assisting disabled adults. Chapman states, “It was a perfect project that God prepared with the perfect timing, a convenient location, hard-working people….It was a “Second Chance” for me to go back to school and resume my career after surviving cancer.”

Chapman’s personal story inspires others including disabled workers to face their circumstances with courage. If organizations and savvy media personalities want someone who can encourage people during National Disability Employment Awareness Month, Chapman would be an excellent selection.

Blair Rewards Unwanted by Middle Class with New Labour Government Changes

It seems as though the Blair rewards program is coming to a head. Influence across too many political camps gets noticed over time. By switching and trying to bridge the gap between the Labour party and the Conservatives with influential power across all camps is a gutsy move stemming from the historic blair rewards that Tony Blair is becoming more and more well-known.

The blairrewards have come about full circle with a lucrative and suspicious appointment to JP Morgan. It is a sweet package that further entices additional political figures to potentially reconsider their participation in the Blair rewards program. The Blair rewards program is a bit like follow the leader that many individuals played as children. The only difference is that the consequences of follow the leader as a child are far less devastating and typically much less devious than when the leader of a world power manipulates the system to create death and destruction in Iraq only to manage assets in the area for a sizable return.

It is true that the typical political salary is not competitive to the top ranking business men in the world, which is perhaps why blair rewards worked so well. The middle class is tired of footing the bill for system manipulation for self-serving constituencies. Perhaps the appointment for several million dollars a year to consult on foreign investments in Iraq would not be such a bad reward if the means to which one got to the appointment was not through such unjust and diabolical means.

It seems as though JP Morgan is essentially following Tony Blair’s lead by putting together their own Blair reward program designed to give Blair rewards for allowing them to make so much money as a result of the war in Iraq. Logically, it makes sense that he would have some type of golden parachute for using government money to fund businesses to fight a war. Why wouldn’t the businesses give Blair rewards? He scratched their backs and now they are scratching his.

It is sad that politicians and big business is unable to generate more creative means from which to take money from the public and turn it into profit for organizations. The blairrewards that has become popular through Tony Blair’s actions are clearly not his own brainchild. The Blair rewards program happens every day in business and politics. This is why there are ethics training courses and policies and procedures that are in place.

The Blair rewards program is clearly something that occurs on a daily basis all over the world. The most tragic thing about it is that the Blair rewards result in a horrible direction for humanity and society. Where one can forgive a luxury vacation in order to get a deal closed in business, the extent of this type of manipulation in world politics with tragic means is unforgivable

As our society continues to try to understand itself blairrewards helps to show us that we are not progressing as one would hope. BT Business Research Shows Britain’s Workers On 6 Day Weeks To Keep Jobs

New BT Business* research has shown that overtime is becoming the norm for almost 50% of staff since the financial crisis began. More than a third of those Brits feel compelled to work over their contracted hours every week because of the current climate, with most working an average of 7 extra hours per week – the equivalent of an extra day – and collectively putting £200 million in extra hours into the British economy each week**.

The findings also show a clear gender split with men more likely to be putting in the extra hours, including 66% of men stating they are working over the recommended 48 hour week.

More than a third (37%) of the 4000 survey respondents put in extra hours to cope with growing workloads. Colleagues being made redundant (41%) and a renewed focus by companies on improving customer service (35%) were cited as the top two reasons for this. However, over 40% also cited that this situation was being exacerbated by time being wasted in the work place because staff are not equipped with the right tools to do the job.

“These findings reflect the length that employees are willing to go to, to keep Britain’s economy afloat”, said Bill Murphy, managing director, BT Business, “Employers should look to match these efforts by equipping staff with what they need to become more efficient. Financial incentives may not be an option, but companies should consider how working practices can eliminate wasted time and boost productivity. Using technology to support practices such as flexible working can help companies strip out the fat as well as helping their staff become more efficient with a better work life balance.”

The research also revealed a drastic change in the office atmosphere with 37% of workers stating there is less laughter in the workplace compared to over a year ago and greater pressure on staff to perform. 43% of respondents believe that the offer of flexitime would help to create a better working experience. Flexible working including the option to work from home and improved technology (33%) also equally factored highly in people’s aspirations on how they’d like their workplace to change.

Workers showed a clear willingness to go that extra mile to impress the boss. 43% of respondents admitted to being motivated to work harder to keep their jobs, with 60% feeling very lucky to have a job. 34% of those surveyed admitted to turning up earlier for work and a similar number (39%) admitted they are being more proactive and have generally pulled up their socks to keep in the bosses good books.

The research was launched at BT Business Experience, a free week-long event held recently in London. As well as leading entrepreneur Peter Jones, prominent business experts were on hand to offer one-to-one advice on key issues facing the SME (small and medium sized enterprise) community in these difficult times and how they may be able to use technology previously only available to large companies to help them succeed and thrive.
